Introduction of direct lodgement for War Pension and Armed Forces Compensation appeals in England and Wales.

by Leigh Rhodes - WEA CASO Officer

Claimants in England and Wales wishing to bring an appeal against decisions on War Pension and Armed Forces Compensation claims made after 5 April 2023, now appeal directly to the First Tier Tribunal, rather than the decision maker- Veterans UK. A new form (WPA1) and information on how to appeal is available at: War Pensions and Armed Forces Compensation Tribunal: How to appeal - GOV.UK (www.gov.uk)

In addition to the new procedure for appeals on decisions after 5 April 2023, new rules impose a requirement on Veterans UK, as the respondent, to serve evidence within 56 days for most AFCS and all WPS appeals, and 28 days for AFCS appeals where a reconsideration needs to be undertaken before the appeal proceeds.

Decisions dated on or before 5 April 2023 and live appeals already lodged with Veterans UK, will progress under the old rules.
